Can an HOA Block Foreign Domestic Workers From Entering Estates?

A Homeowners' Association (HOA) is a group that manages and runs a security residential estate or housing developing schemes. They handle things like keeping the roads and security systems working. HOAs can set rules to control who comes into the estate, but these rules must be fair.

What an HOA Can Do

An HOA gets its authority from a legal document. This could be a memorandum of incorporation (MOI) for an HOA that's a non-profit company which is governed by the Companies Act, or a constitution for a common law associations, which is established under common law and operates according to its constitution, guided by the common law. A committee of residents is in charge, and they make and enforce rules. The rules for visitors and workers must be applied fairly and consistently to everyone.

Rules for Hiring Foreign Workers in South Africa

South Africa has specific laws, mainly the Immigration Act, that say foreign people must have a valid work permit to be employed. If you hire a foreign worker without a proper permit, you could face a fine or even go to jail. As an employer, you're responsible for checking that your worker is legally allowed to work.

The HOA's Role with Foreign Workers

An HOA cannot refuse entry to a foreign worker just because of their nationality. That's discrimination, and it's illegal. However, an HOA can require a foreign worker to show a valid work permit. This isn't discrimination because the law requires the permit anyway.

The homeowner or contractor who hires the

worker is the one legally responsible for making sure the worker has the right paperwork. The HOA's rules about this must be reasonable and have a good reason, like for security. They shouldn't make it overly difficult for residents to hire foreign workers.

HOAs can use different methods to check who's coming in, like:

  • Requiring a pre-clearance code.
  • Scanning ID documents.
  • Registering domestic workers, including their work permits.

If a foreign worker doesn't have a valid permit, the HOA can refuse or cancel their access, but they can't fine or punish them like a court can. That's up to the government.

In the end, while an HOA can have security rules, these rules must be legal, fair, and not discriminatory. The responsibility to make sure a foreign worker is legally employed always falls on the employer (the homeowner). Getting this right protects both the employer and the worker from legal trouble.
